Usually when a business resolves an investigation or litigation with the ACCC they are required to implement a comprehensive Competition and Consumer Law Compliance Program (Compliance Program).
Often there is a further obligation on the business to retain an independent reviewer whose role it is to conduct an intensive and thorough review of the business's Compliance Program each year for three years.
An independent reviewer is required by the ACCC to check that the business has completed all it obligations in establishing a Compliance Program, as well as determining whether the Compliance Program is operating effectively in terms of preventing further contraventions of the Competition and Consumer Act.
The independent reviewer is required prepare a report to verify that the business's Compliance Program is operating effectively.
